Terms of Service
The American Heart Association (“AHA”) offers this platform, a service located at https://precision.heart.org. Use of the data made available via the AHA Precision Medicine Platform ("AHA-PMP") is generally unrestricted (see “Content, Data Rights, and Usage”). However, the service through which we make that data available is offered subject to your acceptance of the terms and conditions contained herein as well as any relevant sections of the AHA Website Policies.
The service (“AHA-PMP”) through which you may access public data or private data served via the AHA-PMP is subject to these terms. Use of AHA-PMP constitutes acceptance to this Agreement.
Content, Data Rights, and Usage
Unless otherwise noted, the content, data, documentation, code, and related materials on AHA-PMP is public domain and made available with a Creative Commons CC0 1.0 Universal dedication. In short, AHA waives all rights to the work worldwide under copyright law, including all related and neighboring rights, to the extent allowed by law. You can copy, modify, distribute, and perform the work, even for commercial purposes, all without asking permission. AHA makes no warranties about the work, and disclaims liability for all uses of the work, to the fullest extent permitted by applicable law.
Some data on AHA-PMP may not be public domain, such as copies of copyrightable works made available to the AHA by private entities. AHA may make these works available under the fair use provision of the Copyright Act or as a result of regulatory directives. Therefore, your rights to use those works may be similarly limited. Works where CC0 do not apply will be clearly marked by a warning in the relevant documentation (for example: “This data is not in the public domain. Third party copyrights may apply.”).
When using content, data, documentation, code, and related materials from AHA-PMP in your own work, we ask that proper credit be given. An example citation is provided below:

Right to Limit
Your use of AHA-PMP may be subject to certain limitations on access, calls, or use as set forth within this Agreement or otherwise provided by AHA. These limitations are designed to manage load on the system, promote equitable access, and prevent abuse. If AHA reasonably believes that you have attempted to exceed or circumvent these limits, your ability to use AHA-PMP may be temporarily or permanently restricted. AHA will monitor your use of AHA-PMP to improve the service or to ensure compliance with this Agreement.
Your level of access to systems and networks owned by AHA is limited to ensure your access is no more than necessary to perform your legitimate tasks or assigned duties. If you believe you are being granted access that you should not have, you must immediately notify the AHA Operations Center PMP_Admin@precision.heart.org
Your access to systems and networks owned by AHA is governed by, and subject to, all federal laws, including, but not limited to, the Privacy Act, 5 U.S.C. 552a, if the applicable AHA system maintains individual Privacy Act information. Your access to AHA systems constitutes your consent to the retrieval and disclosure of the information within the scope of your authorized access, subject to the Privacy Act, and applicable state and federal laws.
If you wish to terminate this Agreement, you may do so by refraining from further use of AHA-PMP. AHA reserves the right (though not the obligation) to refuse to provide AHA-PMP to you if it is AHA opinion that use violates any AHA agreement or Federal policy or law. AHA also reserves the right to stop providing AHA-PMP at any time for any reason in its sole discretion. All provisions of this Agreement, which by their nature should survive termination, shall survive termination including warranty disclaimers and limitations of liability.
AHA reserves the right, at its sole discretion, to modify or replace this Agreement, in whole or in part. Your continued use of or access to AHA-PMP following posting of any changes to this Agreement constitutes acceptance of those modified terms. AHA may in the future, offer new services and/or features through AHA-PMP. Such new features and/or services shall be subject to the terms and conditions of this Agreement.
Disclaimer of Warranties
The AHA-PMP platform is provided “as is” and on an “as-available” basis. While we will do our best to ensure the service is available and functional as much as possible, AHA hereby disclaim all warranties of any kind, express or implied, including without limitation the warranties of merchantability, fitness for a particular purpose, and non-infringement. AHA makes no warranty that AHA-PMP data will be error free or that access thereto will be continuous or uninterrupted.
Limitations on Liability
In no event will AHA or any data contributor be liable with respect to any subject matter of this Agreement under any contract, negligence, strict liability or other legal or equitable theory for: (1) any special, incidental, or consequential damages; (2) the cost of procurement of substitute products or services; or (3) for interruption of use or loss or corruption of data.
The requester agrees to indemnify and hold harmless the AHA and all employees and contractors, data contributors, their Regents, officers, agents and all employees from any liability, loss or damage they may suffer as a result of claims, demands, costs or judgments against them arising out the activities to be carried out pursuant to the obligations under the agreement in question, including but not limited to the use by Requestor of the results obtained from activities performed by Requestor under the agreement in question
This Agreement constitutes the entire Agreement between AHA and you concerning the subject matter hereof, and may only be modified by the posting of a revised version on this page by the AHA.
No Waiver Rights
AHA’s failure to exercise or enforce any right or provision of this Agreement shall not constitute waiver of such right or provision.
The PMP (including any linked sites) may be accessed from the United States of America, as well as from other countries around the world. THIS USER AGREEMENT, AND YOUR USE AND ACCESS OF THE PMP IS GOVERNED BY THE LAWS OF THE STATE OF TEXAS, WITHOUT REGARD TO ITS CONFLICT OF LAWS RULES. JURISDICTION AND VENUE FOR ANY CAUSE OF ACTION ARISING UNDER THIS AGREEMENT SHALL BE IN DALLAS COUNTY, DALLAS, TEXAS. AHA makes no representation that the PMP is appropriate or available for use in locations outside the United States of America. You agree not to access the PMP from any country or jurisdiction where its content is illegal or prohibited. If you choose to access the PMP from outside the United States, you do so on your own initiative and you are responsible for compliance with local laws.
You agree that this User Agreement sets forth the entire understanding between you and the AHA. You further agree that if any portion of this User Agreement is held invalid, the balance shall continue in full force and effect.
